General Terms of Use of the ECLI Application

1. Introduction

These General Terms govern the use of the ECLI mobile application. The Operator of the Application is:

By using the Application, the user confirms that they have read and agree to these Terms.

2. User Account

Registration may be required to use certain features.

The user is required to provide truthful and up-to-date information.

The user is responsible for protecting their login credentials.

The user must not allow unauthorized persons to use their account in a manner that could compromise the security of the Application or other users.

3. Application Features

The Application may provide, in particular:

user registration,
reservations,
catch records,
uploading photographs,
database of individual fish,
automated fish recognition,
statistics,
historical records,
rankings,
sharing photographs,
other related services.

The scope of features may be changed and updated on an ongoing basis.

4. User Content

The user may upload photographs, texts, catch data and other content to the Application. The user is responsible for ensuring that they have all necessary rights and authorizations to use such content. The user must not upload content whose use infringes the rights of third parties.

5. Photographs

Photographs may depict:

a fish,
the user,
the user's face,
other persons,
the environment or location of the catch.

The user is responsible for ensuring that the photograph may be used in the Application. If the photograph contains another person, the user is required to obtain the relevant authorization if required by applicable law.

6. License to Photographs

By uploading a photograph, the user grants the Operator a non-exclusive, royalty-free, territorially unrestricted and perpetual license to use it to the extent necessary for:

operation of the Application,
display,
storage,
technical processing,
backup,
catch records,
creation of a historical record of the fish,
comparison of photographs,
recognition of individual fish,
development and improvement of the Application,
development and improvement of fish identification technologies.

The license shall remain in effect for the duration of the applicable economic rights in the photograph. The user remains the holder of the rights to which they are entitled under applicable law.

7. Use of Photographs for Marketing

The Operator may use a photograph for marketing purposes only to the extent permitted by the applicable legal basis and the terms of the authorization granted by the user. If the Operator intends to use a photograph containing an identifiable person in advertising materials outside the Application, separate consent or other specific authorization may be required.

8. Social Media

The user may, depending on the available features, share a photograph on social media. When shared, the photograph may be supplemented with the name or logo of the Application. Sharing is performed voluntarily by the user. The Operator is not responsible for the subsequent processing of the photograph by the social media platform.

9. Database of Individual Fish

One of the core values of the Application is the database of individual fish created from photographs and catch data. The Operator may:

create records of individual fish,
link photographs of the same individual fish,
record historical data,
track the development of the fish,
compare individual catches,
use data to develop the recognition system.

The historical record of a specific fish may continue to exist even after the user account has been cancelled, in accordance with applicable law and the Privacy Policy.

10. Ownership of the Database

The database created by the Operator, its structure, organization, categorization system, method of linking individual records and technical solution constitute the intellectual property of the Operator or its authorized providers.

The user acquires only the right to use the database to the extent permitted by the Application.

Without the Operator's consent, it is not permitted to:

systematically copy the database,
extract a substantial part of it,
create a competing database,
obtain data by automated means,
use the database for commercial purposes outside the Application.

11. Development and Automated Recognition

The Application may use automated technologies to recognize individual fish. The result of automated recognition may not always be correct.

The user acknowledges that the system may:

incorrectly identify a fish,
fail to identify a fish,
assign a photograph to an incorrect historical record,
require correction or verification.

The Operator may continuously update and improve the system.

12. Accuracy of Data

Catch data may be entered partially by the user. The Operator cannot guarantee that all data entered by the user are accurate. The user is responsible for the accuracy of the data they enter.

13. Prohibited Use

The user must not:

compromise the security of the Application,
circumvent technical protection measures,
perform scraping,
copy the database,
use automated tools to obtain data without authorization,
upload malicious software,
infringe the rights of third parties,
use the Application for unlawful purposes.

14. Service Availability

The Operator strives to ensure the availability of the Application but cannot guarantee its uninterrupted availability. Temporary unavailability may occur, for example, due to:

maintenance,
updates,
technical failure,
service provider outage,
cyberattack,
force majeure.

15. Account Cancellation

The user may request cancellation of their account. However, cancellation of the account does not automatically mean deletion of historical data about fish if the Operator may continue to retain such data in accordance with the Privacy Policy and applicable law.

16. Liability

The Operator is not liable for:

inaccuracies in data entered by the user,
errors in automated recognition,
the content of photographs uploaded by users,
subsequent processing of a photograph by a social media platform,
damage caused by unauthorized use of the account by the user.

This does not affect any rights of the user that cannot be excluded or limited under applicable law.

17. Changes to the Application

The Operator may modify, update or expand the Application.

18. Changes to the Terms

The Operator may update these Terms. The user will be appropriately informed of any material changes.

19. Governing Law

These Terms are governed by the laws of the Slovak Republic to the extent permitted by mandatory provisions of consumer protection law.

21. Effective Date

These Terms shall enter into effect on 10 August 2026.
