License Terms for Photographs and User Content

1. Purpose

These License Terms govern the Operator’s rights to photographs and other content uploaded by the user to the ECLI Application.

2. Ownership of the Photograph

By uploading a photograph to the Application, the user does not automatically transfer ownership or copyright in the photograph to the Operator.

The user remains the holder of the rights to which the user is entitled under applicable law.

However, the user grants the Operator a license in accordance with these Terms.

3. Scope of the License

The user grants the Operator:

a non-exclusive, royalty-free, territorially unrestricted and perpetual license to use the photograph to the extent necessary for:

storage of the photograph,
backup,
technical processing,
display in the Application,
display in the user profile,
display in the historical catch record,
assignment of the photograph to a specific fish,
comparison with other photographs,
automated processing,
development and testing of the fish recognition system,
improvement of the system’s accuracy,
creation of statistical and analytical outputs,
development of the Application,
creation of technical copies,
retention of historical records.

4. Term of the License

The license is granted for the duration of the economic rights in the photograph.

Cancellation of the user account does not in itself automatically terminate the license to the extent necessary to preserve historical records, the database of individual fish, and the development of the recognition system.

5. Territorial Scope

The license is territorially unrestricted.

6. Technical Modifications

The Operator may technically modify the photograph to the extent necessary for:

format conversion,
compression,
resizing,
creation of a thumbnail,
technical tagging,
secure storage,
automated analysis.

Such technical modifications do not constitute an alteration of the content of the photograph beyond what is necessary for the operation of the Application.

7. Development of the Recognition System

The Operator may process the photograph for the purpose of:

identifying a specific fish,
comparing it with existing records,
creating a historical profile of the fish,
improving the algorithm,
testing the accuracy of the system,
evaluating system errors.

8. Historical Database

The photograph may be included in the historical record of a specific fish.

The historical record may remain preserved even after the user account has been cancelled.

9. User Responsibility

The user declares that:

the user has the right to upload the photograph,
the user does not infringe the copyright of any third party,
the user does not infringe personality rights,
the user does not infringe the right to privacy,
the user has the necessary authorizations in relation to persons depicted in the photograph, if required by applicable law.

10. Photographs of Other Persons

If the photograph contains another person, the user is responsible for ensuring that publishing and using it in the Application does not infringe that person’s rights.

11. Marketing

The license under these Terms primarily applies to the operation of the Application, the database, and the development of the system.

The use of a photograph of an identifiable user in a separate marketing campaign of the Operator outside the Application may be subject to a separate legal basis or specific consent.

12. Social Media

The user may voluntarily share the photograph on social media.

When shared, the photograph may be supplemented with the name or logo of the Application.

13. Royalty-Free License

The license is granted free of charge.

The user is not entitled to any remuneration from the Operator for the use of the photograph within the scope of this license.

14. Protection of Third-Party Rights

If a third party asserts a legitimate claim against the Operator in connection with a photograph uploaded by the user, the Operator may temporarily disable access to or remove the photograph and take other appropriate measures.

15. Effective Date

These License Terms shall enter into effect on 10 August 2026.
